These General Terms and Conditions (hereinafter: Terms) set out the conditions for using the services that can be ordered online through the https://siteflow.hu website and its subdomains from Attila Fiedler, a sole proprietor (hereinafter: Service Provider).

The contract concluded under this document is not filed and cannot be accessed afterward; the order details serve as evidence that the contract was concluded. The contract is concluded through conduct indicating acceptance, does not constitute a written agreement, is drawn up in Hungarian, and does not refer to any code of conduct. These Terms are continuously available and can be downloaded from https://siteflow.hu/aszf.

What these Terms do NOT cover. Custom website, online store, and system development projects, as well as advertising management engagements, are governed by separate agreements individually negotiated by the parties — except the custom website service that can be ordered online under Section 11 (with a set-up fee, by subscription or one-off payment), which is governed by Section 11 and the individual agreement referred to there. These Terms apply to services that can be ordered and paid for directly online through the website.

Language of this document. These Terms are a translation prepared for English-speaking clients. The service is provided from Hungary and the Hungarian version is the legally binding one; where the two differ, the Hungarian text prevails. The Hungarian original is available at siteflow.hu/aszf, and the Provider will explain any provision in English on request at info@siteflow.hu.

Who this service is for. The custom website development described in Chapter 11 (siteflow.hu/en/websites) is offered to registered businesses only: the questionnaire requires a valid EU VAT number, which the Provider verifies before invoicing. The consumer provisions in Chapters 6 and 8 apply to the Provider’s other services and to any case where the client nevertheless qualifies as a consumer.

2. General provisions

2.1. Any matters not governed by these Terms and Conditions shall be governed by Hungarian law, in particular Act V of 2013 (Civil Code), including Sections 6:157–6:167 on defective performance, Act CVIII of 2001 on electronic commerce services (E-Commerce Act), and Government Decree 45/2014. (II. 26.) on the detailed rules governing contracts between consumers and businesses. The mandatory provisions of the applicable laws shall apply to the parties without any separate stipulation.

2.2. These Terms and Conditions are effective from September 5, 2026, and shall remain in effect until withdrawn. The Service Provider shall publish any amendments on the website. Amendments shall not have retroactive effect and shall not affect contracts concluded previously.

2.3. The Service Provider reserves all rights to the website, any part of it, and the content displayed on it. Downloading, electronically storing, processing, or selling the content displayed on the website or any part of it without the Service Provider's written consent is prohibited—except for this document and the privacy policy.

2.4. The Service Provider assumes no responsibility for the content of third-party websites linked from the website.

3. Scope of services and fees

3.1. The relevant pages of the website specify the scope, exact content, extent, and fees of the services available to order online. Before finalizing the order, the User will see an itemized breakdown of the total amount payable.

3.2. The listed fees are in Hungarian forints. The Service Provider has opted for VAT-exempt status under Chapter XIII (Sections 187–196) of Act CXXVII of 2007 on Value Added Tax (VAT Act); therefore, the fees do not include value-added tax; the amount shown on the website is the final amount payable. No additional costs will be charged on top of the fees.

3.3. The Service Provider reserves the right to change the fees. Such changes will not affect orders that have already been confirmed. If the Service Provider's VAT-exempt status ends in the future for any reason, this will likewise not affect the fees for orders that have already been confirmed.

3.4. Incorrect fee. If an obviously incorrect fee is displayed (e.g., 0 HUF, 1 HUF, or an amount that does not reflect the stated discount), the Service Provider is not required to confirm the order at that fee; the Service Provider may offer to confirm the order at the correct fee, which the User may accept or reject. If the User rejects the offer, or if the Service Provider does not confirm the order for any other reason, the Service Provider will refund the full amount already received without delay, but no later than 14 days, using the original payment method.

3.5. Credit for the Website X-ray fee

If, within 90 calendar days of receiving the Report, the User enters into a contract with the Service Provider for a custom website, online store, or system development project, the Service Provider will deduct the full fee paid for the Website X-ray from the project fee as a discount. The credit applies regardless of the size or type of the project and cannot be subject to any additional conditions.

The credit may be applied up to the amount of the project fee, cannot be redeemed for cash, and cannot be used after the 90-day period has expired. If the project contract is later terminated for any reason, the credited amount will be treated as the fee for the Website X-ray when the parties settle their accounts—the Service Provider may not separately recover it from the User.

3.6. Satisfaction guarantee (voluntary commitment by the Service Provider)

The Provider undertakes that, if the Report does not contain at least three substantive findings, it will refund the full fee for the Website X-ray at the User’s request.

A substantive finding is a numbered observation in the Report that relates to a specific, identified element of the website examined and names an action that can be carried out. If the parties disagree as to whether a finding is substantive, the Provider decides in the User’s favour.

The claim must be notified within 14 calendar days of the Report being delivered, at info@siteflow.hu; no reasons need be given. The Provider refunds the fee within 14 days of the notification.

This guarantee applies in addition to the rights the Consumer has under the law; it neither limits nor replaces them.

4. Formation of the contract (ordering process)

4.1. The User places an order by completing the order form on the website: selecting the service and any additional services, providing the required information (name, email address, billing information, and the URL of the website to be reviewed), accepting these Terms and Conditions, and reviewing the Privacy Policy.

4.2. Correcting data entry errors. Before finalizing the order, the User may go back and correct the information provided at any time. After finalizing the order, the User may request the correction of any errors by phone or email.

4.3. By placing the order, the User acknowledges that, pursuant to Section 15 of Government Decree 45/2014 (II. 26.), the order entails an obligation to pay; the button used to finalize the order is labeled clearly and accordingly.

4.4. Automatic confirmation. After submitting the order, the User receives an automatic confirmation by email. If this confirmation is not received within 48 hours at the latest, the User is released from being bound by the offer. The Service Provider excludes its liability for a confirmation not arriving on time if the User provided an incorrect email address or the User’s mailbox is full.

4.5. Formation of the contract. The contract is formed upon successful completion of payment. After the contract is concluded, the Service Provider sends confirmation within a reasonable period on a durable medium (by email), which, pursuant to Section 18 of Government Decree 45/2014 (II. 26.), includes the service ordered, the fee, the performance deadline, these Terms and Conditions, and—if the User made such a declaration—confirmation of the declaration under Section 6.3 concerning the commencement of performance and the loss of the right of withdrawal.

4.6. Payment methods. Online credit or debit card payment is available on the website. Within the European Economic Area, payment services are provided by Stripe Technology Europe, Limited (One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland; authorized by the Central Bank of Ireland, reference number: C187865); other parts of the service are governed by the agreement with Stripe Payments Europe, Limited (One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland). The Service Provider has no access to card details and does not store or process them; the payment transaction takes place on the payment service provider’s own platform.

4.7. Invoicing. The Service Provider issues an electronic invoice for the service in accordance with applicable law and sends it to the email address provided by the User. Pursuant to Section 169(m) of the VAT Act, the invoice contains a clear reference to the tax exemption.

4.8. Language and market context of the service. The Service is provided in Hungarian and is prepared for the Hungarian legal and market context; the findings in the Report apply to this context. The Service Provider does not restrict orders based on the User’s citizenship or place of residence.

5. Service delivery, cancellation, rescheduling

5.1. Delivery deadline. The Service Provider will prepare and electronically deliver the written Website X-ray Report to the User within 3 business days of the contract being concluded and the URL of the website to be reviewed being provided.

5.2. Scheduling the video consultation. The parties will agree on a time for the video consultation of up to 30 minutes included with the Report after the Report has been delivered. The video consultation may be scheduled within 30 calendar days of delivery of the Report; after this period—or if the User declines the video consultation—the service will be deemed fully performed.

5.3. The User’s obligation to cooperate. The User must provide all information required to perform the service (in particular, the URL of the website to be reviewed and, in the case of a Competitor Comparison, the URLs of the competitors’ websites) completely and accurately. The delivery period will not begin until all required information has been provided. The Service Provider is not liable for any consequences arising from incomplete or inaccurate information that are not attributable to the Service Provider.

5.4. Rescheduling an agreed appointment. The agreed time of the video consultation may be rescheduled free of charge no later than 24 hours before it begins by contacting info@siteflow.hu or +36 20 381 2463. If the User cancels within 24 hours or fails to attend, the Service Provider will offer a new appointment free of charge on one occasion. If the User again fails to attend without prior notice, the video consultation may still be scheduled within the period specified in Section 5.2, but the Service Provider is not required to offer another appointment. The Report will be delivered regardless, and the fee will not be reduced as a result.

5.5. Inability of the Service Provider to perform. The Service Provider may reschedule the agreed appointment if performance is prevented for reasons not attributable to the Service Provider (e.g., illness or force majeure). In such cases, the Service Provider will notify the User immediately and offer a new appointment; if the User does not accept it, the Service Provider will refund the fee already paid in full without delay, but no later than within 14 days.

5.6. Technical requirements for delivery. The Service Provider will deliver the Report by email in PDF format; standard PDF reader software is required to open it. The video consultation will take place through a browser-based video conferencing service, for which the User will need an internet connection, a microphone, and a modern browser; registration is not required. The Service Provider will record the video consultation only with the User’s prior consent.

5.7. Use of the Report. The Report is prepared for the User’s own business purposes and is an intellectual work of the Service Provider protected by copyright. The User may share the Report without restriction with its own employees, contractors, and other contributors (including, in particular, the person who develops or operates its website). The Report may not be made public, sold separately, or provided to a third party as a service without the Service Provider’s prior written consent.

5.8. Nature of the Report. The Report contains expert opinions and recommendations. The Service Provider does not guarantee any business results (traffic, conversions, or revenue) from implementing the recommendations, as these also depend on factors outside the Service Provider’s control.

6. Right of withdrawal and termination (mandatory information for Consumers)

Under Government Decree 45/2014 (II. 26.), the Consumer has the right to withdraw from or terminate a service contract concluded remotely without giving a reason. This section may not be restricted to the Consumer's detriment.

6.1. The Consumer may withdraw from the contract without giving a reason within fourteen (14) days from the date the contract is concluded or—if performance has already begun—may terminate it.

6.2. If the Service Provider fails to fulfill this information obligation, the withdrawal period is extended by twelve months.

6.3. Beginning performance within the 14-day period

The Service Provider will perform the service within 3 business days from the conclusion of the contract and therefore within the 14-day withdrawal period. This requires the Consumer's express prior consent. In this case:

  • the Consumer may exercise the right of termination even after performance has begun but, under Section 26 of Government Decree 45/2014, must pay the proportionate fee for the service performed up to the date the termination is communicated;
  • once the service has been performed in full, the Consumer loses the right of withdrawal/termination, provided that performance began with the Consumer's express prior consent and acknowledgment that this right would be lost once performance was complete (Government Decree 45/2014, Section 29 (1) a)).

During the ordering process, the Consumer provides this consent by selecting a separate checkbox that is not preselected. Without this consent, the Service Provider will not begin performance until the 14-day period has expired.

When no payment is required (Government Decree 45/2014, Section 27). The Consumer is not required to pay any fee if the Service Provider failed to provide the information required under this section or if the Consumer did not request that performance begin before the withdrawal period expired.

6.4. Exception to the right of withdrawal

Under Section 29 (1) a) of Government Decree 45/2014 (II. 26.), the Consumer has no right of withdrawal after the service has been performed in full if the Service Provider began performance with the Consumer's express prior consent and the Consumer acknowledged that the right of termination would be lost once the service had been performed in full. The time of full performance is defined in Section 5.2.

6.5. Notice of withdrawal/termination

The Consumer may exercise the right of withdrawal/termination by making an unambiguous statement (by e-mail at info@siteflow.hu, by mail to 1191 Budapest, Kisfaludy utca 16. 10. em. 30., or by phone at +36 20 381 2463) or by using the model statement included in the appendix to these Terms and Conditions.

The Consumer may also communicate the intention to withdraw using the "Withdraw from the contract" online withdrawal function available at https://siteflow.hu/elallas and through the link included in confirmation e-mails. This function remains continuously available throughout the withdrawal period. When this function is used, the Service Provider will confirm receipt without undue delay by providing an acknowledgment on a durable medium (by e-mail), which includes the content of the withdrawal statement and the date and time it was submitted.

For written notices, the date of mailing or the time the e-mail was sent will be taken into account. The deadline is considered met if the Consumer sends the statement before the 14-day period expires.

6.6. Refunds

The Service Provider will refund the full amount paid by the Consumer (less the proportionate fee specified in Section 6.3) without delay and no later than fourteen days after learning of the withdrawal, using the same payment method used for the original transaction, unless the Consumer expressly agrees to another method. The Consumer will not incur any additional costs as a result of the refund.

6.7. The right of withdrawal/termination applies only to the Consumer, not to a Business acting within the scope of its trade, profession, or business activities. Regardless of this, the Service Provider offers the satisfaction guarantee specified in Section 3.6 to all Users.

7. Defective performance, warranties, liability

7.1. The Service Provider's performance is defective if, at the time of performance, the service does not meet the quality requirements established in the contract or by law. Performance is not defective if the entitled party knew or should have known of the defect when the contract was concluded.

7.2. Warranty for defects. In the event of defective performance, the User may assert a warranty claim under Sections 6:159–6:167 of the Civil Code: at the User's discretion, the User may request repair (repeated, proper performance of the service), or—if this is not possible or the Service Provider does not agree to provide it—may request a proportionate reduction of the fee or withdraw from the contract. The User may not withdraw from the contract due to a minor defect.

7.3. The Consumer must notify the Service Provider of the defect without delay after discovering it. Under Section 6:162(2) of the Civil Code, a defect reported within two months of its discovery is considered to have been reported without delay. This is not a preclusive period: the Consumer may assert a warranty claim within the two-year limitation period from the performance of the contract; however, the Consumer is liable for any damage resulting from delayed notification.

7.4. In a contract between a Consumer and a business, any provision that deviates from the rules governing warranties for defects to the Consumer's detriment is void.

7.5. Liability. The Service Provider is liable for damage caused by breach of contract in accordance with the rules of the Civil Code. With respect to a User who is not considered a Consumer, the Service Provider's liability—except for an intentional breach of contract or a breach that causes harm to human life, physical integrity, or health (Section 6:152 of the Civil Code)—is limited to the fee for the relevant service. The Service Provider does not limit its liability toward Consumers; Consumers retain all rights granted to them by law.

7.6. Data processing while providing the Repair Package

If the Service Provider makes changes to the User's website as part of the Repair Package and may thereby access personal data processed by the User (e.g., data concerning website visitors or people who complete forms), the Service Provider acts as the User's data processor in this context. In such cases, before work begins, the parties enter into a written data processing agreement in accordance with Article 28(3) of the GDPR, a template of which the Service Provider makes available to the User. Until this agreement is concluded, the Service Provider will not access systems containing personal data.

8. Complaint handling and legal remedies (for Users who qualify as Consumers)

8.1. The Consumer may submit a complaint about the service to the Service Provider verbally or in writing at info@siteflow.hu, by calling +36 20 381 2463, or by writing to 1191 Budapest, Kisfaludy utca 16, 10th floor, door 30.

8.2. The Service Provider will investigate verbal complaints immediately and remedy them as necessary. If the Consumer disagrees with how the complaint is handled, or if an immediate investigation is not possible, the Service Provider will prepare a written record of the complaint and provide a copy to the Consumer. A verbal complaint submitted by telephone will be assigned a unique identification number.

8.3. The Service Provider will provide a substantive written response to a written complaint, in a verifiable manner, within thirty days of receiving it; if the complaint is rejected, the Service Provider will state the reasons. The Service Provider will immediately confirm receipt of complaints submitted electronically.

8.4. The Service Provider will retain the complaint and the substantive response provided to it, in accordance with Section 17/A of the Fgytv., for at least three years and, in view of the general limitation period under the Ptk., for no more than five years.

8.5. If a complaint is rejected, the Service Provider will inform the Consumer in writing which authority or conciliation board the Consumer may contact. General declaration of submission: The Service Provider has not made a general declaration of submission under Section 36/C of the Fgytv. This does not affect the Service Provider's obligation to cooperate in conciliation board proceedings (by submitting a response and attending the hearing through a representative authorized to reach a settlement), nor does it prevent the issuance of a binding decision in the absence of a declaration of submission if the Consumer's claim does not exceed two hundred thousand forints.

8.6. Consumer protection authority

Under Sections 45/A (1)–(3) of the Fgytv. and Government Decree 326/2024 (XI. 14.), the government office, the National Trade and Consumer Protection Authority (NKFH), and the minister responsible for consumer protection act as consumer protection authorities. Contact details: kormanyhivatalok.hu · nkfh.gov.hu

8.7. Conciliation boards

Conciliation boards have jurisdiction to resolve consumer disputes outside court proceedings. Their role is to try to help the parties reach a settlement and, if this is unsuccessful, to issue a decision in the case. The proceedings are free of charge. The Consumer may contact the board with jurisdiction over the Consumer's permanent residence or temporary residence, or the Service Provider's registered office.

If no settlement is reached, the panel will issue a binding decision if the claim is well-founded and the business has made a declaration of submission, or if, in the absence of a declaration of submission, the Consumer's claim does not exceed two hundred thousand forints; otherwise, it will issue a recommendation (Section 36/C of the Fgytv.).

From January 1, 2026, a small or medium-sized enterprise engaged in retail activities may also contact a conciliation board.

For a cross-border consumer dispute related to an online sales or online service contract, the competent conciliation board is the one operated by the chamber designated by decree of the minister responsible for consumer protection.

8.8. Court proceedings

The Consumer may take the dispute to court. Under Section 26 (1) of Act CXXX of 2016 on the Code of Civil Procedure (Pp.), if the business brings an action against the Consumer, only the court with jurisdiction over the Consumer's domestic permanent residence may hear the case. If the Consumer brings an action against the business, under Section 27 of the Pp., the Consumer may also bring the action before the court with jurisdiction over the Consumer's own domestic permanent residence. This right may not be excluded or restricted by any contractual provision. The governing law is Hungarian law.

9. Miscellaneous provisions

9.1. If any part of these General Terms and Conditions becomes invalid or unenforceable, this will not affect the validity of the remaining provisions.

9.2. If the Service Provider does not exercise any right granted under these General Terms and Conditions, such failure will not be deemed a waiver of that right.

9.3. The parties will primarily attempt to settle any disputes amicably.

9.4. Accessibility. Pursuant to Section 3(3) of Act XVII of 2022 on accessibility requirements for products and services, a microenterprise providing services is exempt from the accessibility obligations prescribed by law; the Service Provider qualifies as a microenterprise. Nevertheless, the Service Provider strives to ensure that the website conforms to the WCAG 2.2 Level AA guidelines and continuously improves it. You may submit accessibility-related feedback at info@siteflow.hu.

10. Privacy

The website's Privacy Policy is available on the following page: https://siteflow.hu/adatkezelesi-tajekoztato

11. Custom website development by subscription or one-time payment (siteflow.hu/inditas, siteflow.hu/urlap)

11.1. The service. The Service Provider creates a custom-designed website for the User, which the User may pay for either through a monthly subscription (a 12- or 24-month term, set-up fee + monthly fee) or as a one-time payment (set-up fee + project fee). The detailed terms of the packages, fees, term, the license granted for the Website, delivery of the files, termination, and operation are set out in the individual agreement entered into with the User; in the event of any conflict between the individual agreement and these Terms and Conditions, the individual agreement shall prevail. This section supplements the general rules in Sections 1, 8, 9 and 10 with the exceptions set out here; Sections 2–7 apply to this service only to the extent that the individual agreement or this section does not provide otherwise. The Service Provider has not agreed to be bound by any code of conduct.

11.2. The ordering process. The User (1) completes the questionnaire, (2) reviews the demo page automatically generated from the User's responses (this is a draft that shows the direction and is not identical in every detail to the final website), (3) selects a package and reads the individual agreement filled in for that package on the package selection page, (4) accepts the agreement electronically and pays the set-up fee (the current amount shown on the payment page and in the individual agreement; currently 50 000 Ft) through Stripe's payment interface, (5) receives a copy of the accepted agreement by email, then (6) completes the detailed brief, and development begins following a consultation with the Service Provider. The demo page remains available at its unique link for 14 days and does not constitute an offer for the final website. If the editor mode is available on the demo page (in which case the package selection page summarises the recorded demo state before payment), the state of the demo recorded at the time of the order is the starting point of the detailed brief; what of it is the same on the final website, and what may differ, is set out in the individual agreement.

11.3. Formation and storage of the agreement. Notwithstanding Section 2, the User can read the full text of the individual agreement before ordering, on the package selection page, and accepts it by ticking the checkbox accepting the agreement and these Terms (and, for a subscription, the separate checkbox authorising the recurring monthly charge), ticking the separate checkbox expressly accepting the highlighted clauses, making the declaration on whether the User orders as a business or as a consumer (for a consumer, with a separate, unticked and optional checkbox expressly requesting that performance begin within the 14-day withdrawal period), entering the User's name and pressing the order button, which indicates the obligation to pay; the Service Provider logs the declaration and sends it in the confirmation email. The agreement is concluded when the set-up fee has been paid successfully; if payment is not completed, the acceptance has no effect. The Service Provider records and stores the full text of the agreement, the time of acceptance, the accepting party's name, email address, IP address, browser identifier and the SHA-256 hash of the text; makes the full text available on the package selection page before ordering and sends it by email after payment; and makes the agreement available for later review and printing at any time through the User's unique link. The parties consider the agreement to have been entered into in the form prescribed by Section 6:7 (3) of the Ptk.

11.4. Cancellation, withdrawal and refund — by how far the work has progressed. The User may end the agreement at any time without giving a reason, on their status page (the button shows the amount payable or refundable before it is pressed) or by email; the payment obligation is set out in clause 6 of the individual agreement, in short: (a) before development begins, every fee paid is refunded (see below); (b) after development has begun but before the Website is ready for handover (the day the Service Provider presents the finished Website on a preview link and notifies the User by email), the set-up fee is retained as consideration for the work done, any monthly fee already charged — for a one-time payment, the first instalment of the project fee already paid — is refunded, and nothing further is payable; (c) once the Website is ready for handover, for a subscription a buy-out fee applies, equal to the lowest of 50% of the remaining monthly fees, the fixed buy-out fee, and the difference between the one-off price and the fees already paid, after payment of which the Website belongs to the User; for a one-time payment the full project fee is payable. The User may withdraw without providing a reason until development begins—including after the individual agreement has been concluded. The User may give notice of withdrawal using a button on their status page or by sending an email to info@siteflow.hu. The Service Provider will refund all fees paid up to that point (the set-up fee and any monthly fees already charged) in full on the date notice is given, using the original payment method through the payment service provider (Stripe); depending on the User's bank, the credit will typically appear within 5–10 business days. Once development has begun, points (b)–(c) apply instead.

11.5. Recurring charges. For subscriptions, Stripe charges the monthly fee each month during the term to the payment method provided and stored by the User; the User expressly authorizes these charges when ordering, by ticking a separate checkbox, and may revoke this authorization by terminating the agreement in accordance with its terms or by removing the payment method. The first monthly fee is due one month after the set-up fee is paid. The billing date is the day the set-up fee was paid (if that date does not occur in a given month, the last day of that month); the Service Provider sends an invoice by email when the charge is made. At least 7 days before the first monthly fee is charged, the Service Provider sends a reminder by email (amount, date, how to cancel and its consequences). The monthly fee does not change during the term and may not be increased unilaterally by the Service Provider. The fee and terms for operation after the term, including the authorisation to charge it, are set out in clause 5.3 of the individual agreement. The obligation to pay continues after the payment method is removed or the authorisation is revoked; in that case the User pays by bank transfer on the basis of the Service Provider's invoice.

11.6. Consumers. When ordering, the User declares whether they order as a business or as a private individual (consumer); a consumer is also entitled to the rights set out in Sections 6 and 8, and the more favorable rule in Section 11.4 does not limit these rights. For this service, Section 6 applies with the following differences: the consumer pays the proportionate amount under Section 6.3, but not more than the amount under points (b)–(c) of Section 11.4; without the consumer's express request, performance begins on the 15th day and nothing is payable on withdrawal; the exception in Section 6.4 (full performance) can only arise, for a subscription, at the end of the full term and, for a one-time payment, at the end of the hosting and support period after handover; within the 14 days, a notice given with the cancellation button also counts as withdrawal. Withdrawal may be notified with the “Withdraw from contract” and then “Confirm withdrawal” buttons on the status page, by email, or using the attached model form; the Service Provider confirms receipt by email.

11.7. Late payment, suspension. If a monthly charge fails, a grace period of 7 days applies, a written reminder follows on the 14th day, and from the 30th day the Website may be suspended (the monthly fee remains payable). The Service Provider keeps the Website and its data for 60 days from suspension and sends a reminder by email on the 45th and 55th day; during that time the Website can be restored by settling the debt, or its handover can be requested by paying the buy-out fee. Otherwise the Service Provider may terminate the agreement and take the Website off its hosting; it keeps the files and database for a further 30 days and hands them over on request once the debt is settled, then deletes them; the domain remains in the User's name.

11.8. Breach by the Service Provider. If the agreement ends because of a breach by the Service Provider, the User owes no fee and the fees already paid are refunded.

11.9. Images on the demo page and on the Website.

(a) Uploading own images. If the editor mode is available on the demo page, the User may upload their own photos to the demo. For each image, the User declares separately that they are entitled to use it and that any identifiable person in it has consented to this use of their image (Section 2:48 of the Hungarian Civil Code); the Service Provider logs the declaration with the version of its text, the version of the accepted General Terms, the time it was made and the hash of the image. By making the declaration, the User accepts this clause in respect of the uploaded image, even before the agreement is concluded.

(b) Licence. The User grants the Service Provider a royalty-free, non-exclusive, non-sublicensable licence to the uploaded image (i) to display it on the demo page for as long as the demo is available, and (ii) if an order is placed, to build the Website, to display the image publicly on the Website and to operate the Website under the agreement, for the term of the agreement. The licence covers resizing, cropping, format conversion and compression as needed for display, and the removal of hidden data embedded in the file; beyond this, the Service Provider does not alter the content of the image. The licence extends to the Service Provider's subcontractors (hosting, content filtering) to the extent necessary for these purposes. The Service Provider uses the image for any other purpose, such as its own portfolio or advertising, only with the User's separate consent. The User may delete the image at any time on the Images tab of the demo; deletion ends the licence for the demo.

(c) The User's responsibility. The User warrants that the uploaded image does not infringe any copyright, image or other personality right, trade mark or other right of a third party, and that the User has obtained the consent of any person shown. The User is liable under the applicable law for any third-party claim relating to the use of the image; if such a claim is brought against the Service Provider, the Service Provider informs the User without delay. After the order, clauses 4.4 and 9.2 of the individual agreement also apply to content provided by the User.

(d) Prohibited content. No image may be uploaded that is unlawful, infringes the rights of a third party, is of a sexual nature, depicts violence or self-harm, incites hatred, presents another business's work, premises or products as the User's own, or shows an identifiable minor without the consent of their legal representative.

(e) Filtering and removal. The Service Provider checks uploaded images, AI images generated on the demo and image descriptions with an automated content filter (to screen out sexual, violent and self-harm content); if the filter flags an image, or is unavailable, the image is not uploaded. After five flagged images, no further images can be uploaded to that demo. The Service Provider may also review uploaded images manually. The Service Provider may remove from the demo and from the Website any image that is unlawful or breaches point (d). A removed image is replaced by the original image on the demo; on the Website, the Service Provider uses a similar image. The Service Provider informs the User of the removal by email without delay; the notice states what happened (which image was removed and what is shown in its place), the facts on which the decision is based, whether automated means were used for the decision, the prohibition in point (d) that the image breaches, and the available remedies. The User may contest the decision at info@siteflow.hu, may go to court, and may also use the further remedies set out in Chapter 8.

(f) Reporting. Anyone may report at info@siteflow.hu an image stored by the Service Provider that they consider unlawful. The notice must contain the location of the image (the link of the demo or the Website, or a short description of the image), the reasons why it is considered unlawful, the name and email address of the notifier, and a statement that the notifier believes in good faith that the information in the notice is accurate and complete (Article 16 of Regulation (EU) 2022/2065). The Service Provider confirms receipt, decides on the notice without undue delay and informs the notifier of its decision, stating the available remedies and whether automated means were used for the decision. A person shown in an image may also exercise their right to erasure under the Privacy Policy.

(g) Images made with artificial intelligence. Images on the demo not marked as the User's own photos, including sample images and AI images generated from the User's description, are illustrations generated by artificial intelligence: they do not show a real place, job or product, and the demo states this; if the demo also contains own photos, the AI images in the image spots of the demo are labelled individually. An AI image may not depict an identifiable person, brand marks or lettering; people may appear only in a way that makes them unrecognisable — from behind, at a distance, out of focus or as a detail — and even then the image does not show a real person. The User's description cannot override this. Clause 2.1/A of the individual agreement applies to the labelling of AI images used on the Website.

(h) The rules on processing, transferring and deleting the images as personal data are set out in the Privacy Policy.
